Terms for the game server and the store

1. Scope

These terms apply to the use of the ASCEND Rust server, the Discord server and the store, operated by Jeremy Heinrichs – ASCEND Rust.

2. Server rules

By joining the server you accept the server rules. Staff may warn, mute, kick or permanently ban players who break them.

3. Ranks, kits and RP

  • Ranks, kits, perks and RP are virtual items with no real-world value and are only valid on ASCEND.
  • Unless stated otherwise, purchases are valid for the duration given in the store.
  • Ranks won from kit crates are valid for 14 days.
  • There is no claim to permanent server operation.
  • If you are banned for breaking the rules, purchased items are forfeited without refund.
  • All sales are final. Details in our Refund Policy. Your statutory rights (e.g. if an item is not delivered or does not work as described) remain unaffected.

4. Payment

Payments are processed by the external provider Tebex Limited, who acts as the merchant towards the buyer. Their terms apply in addition.

You must be at least 16 to buy in our store. If you are under 18, you need permission from a parent or legal guardian.

5. Right of withdrawal

For digital content, the right of withdrawal expires once delivery has started with your explicit consent and you have confirmed that you lose your right of withdrawal (§ 356 (5) BGB).

6. Liability

We are not liable for loss of in-game progress due to wipes, server downtime or game updates by Facepunch Studios.

Otherwise we are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are only liable if an essential contractual obligation is breached, and only for the typical, foreseeable damage.

7. Changes to the game

We may change or rebalance kits, perks and features to keep the server fair, as long as this is reasonable for you. The main benefits of a paid rank or perk pack stay in place for the paid duration. If we have to remove one of them, you get an equivalent replacement.

8. Final provisions

German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. If any provision of these terms is invalid, the rest remains valid.
